Description

The Official Register of Public Procurement Contractors is governed by Articles 337 to 345 of Law 9/2017, of 8 November, on Public Sector Contracts. Business owners can register their personal and legal details, authorisations and qualifications, solvency, and business classification, as outlined in Article 339 of the Law. Their certificates are valid for all public sector contracting entities.

The applicant must provide documentary evidence for the information they wish to be entered into the register, as outlined in Article 17 of Royal Decree 817/2009, of 8 May, which partially implements Law 30/2007, of 30 October, on Public Sector Contracts.
Documents
  • In the case of public or private limited companies, the articles of association and any subsequent amendments that reflect the company’s current circumstances for which registration is being requested must be provided.
  • If other legal entities are involved, the constituent documents and the statutes by which they are governed, along with any amendments that reflect the updated circumstances for which registration is being requested, must be provided.
  • Individuals must provide their National Identity Document (DNI) or, for foreigners, equivalent documentation proving their identity, nationality, and address, along with any other documents required to demonstrate their legal capacity. This includes, particularly, tax-related documents and proof of registration in the relevant Social Security System.
  • The appointments of administrators, delegation of powers, and the authority granted to contract with entities that are part of the Public Sector.
  • The annual accounts for the last financial year, approved and filed with the Companies Register or the relevant official register. In the case of individual business owners not registered in the Companies Register or not required to do so, properly completed accounting books must be provided.
  • The titles and documents related to professional authorisations or qualifications, as well as other requirements necessary to operate in a particular sector, must be registered by submitting the original document or an authorised copy.

Place of submission
  • The documents required to support registrations must be authentic (originals or notarised copies) and must be submitted via any of the methods listed below, along with a copy of the acknowledgement of receipt of the registration request in ROLECE.
  • The electronic file must be signed with the electronic signature of the issuer (Notary or Registrar). Files signed by the applicant will not be accepted unless the documentation includes the CSV (secure verification code).
  • The original document or a certified or authenticated copy must be presented at Calle de Alcalá, nº 9 (or at any of the designated registration points in accordance with Article 16 of Law 39/2015, of 1 October, on the Common Administrative Procedure of Public Administrations).
  • By mail, addressed to Calle Alcalá, nº 9, Madrid 28070, referencing the proceedings initiated through ROLECE.
  • Originals, certified, or authenticated copies should be presented at any office of the Ministry of Finance and Civil Service for forwarding to the Government Commerce and Procurement Office and Contract Registry, with reference to the procedure initiated through ROLECE.
  • The Annual Accounts will be sent directly from the Companies Register website (http://www.registradores.org) to ROLECE at cuentasanuales@patrimoniodelestado.es.
