Description: This procedure allows requesting before this Entity the issuance of a report analyzing the financial sustainability of works concession contracts and service concession contracts, as well as the economic rebalancing agreements to be adopted in these types of contracts, in accordance with the provisions of Article 333 of Law 9/2017, of November 8, on Public Sector Contracts, transposing into Spanish law the Directives of the European Parliament and of the Council 2014/23/EU and 2014/24/EU, of February 26, 2014 and Article 1 of Order HFP/1381/2021, of December 9, regulating the organization and operation of the National Evaluation Office.

Explanatory memorandum on the subject of the procurement project
The file must include either a feasibility study or, where appropriate, an economic-financial feasibility study, in accordance with articles 247 and 285 of Law 9/2017, of 8 November. The study will include an analysis of the project's demand and other elements of sustainability.
Reusable spreadsheet formats is a key component of the economic and financial information incorporated into the feasibility study or economic and financial analysis of the dossier.
Proposal for administrative and technical specifications
Report from the legal department on the specific administrative clause specifications.
In accordance with Article 324.6 of Law 9/2017, of 8 November, the Ministry of Finance and Public Function and the Technical Committee of National Accounts are required to submit reports when necessary.
Report from the Higher Committee on State Contract Prices or an equivalent regional body, in accordance with the provisions of Article 9 of Royal Decree 55/2017, of 3 February, when this is necessary to conclude the contract.
Contract subject to modification, administrative specifications and technical specifications and report of the legal service.
Economic-financial plan for the concession.
Proposal for a modification to the contract, together with an explanatory report setting out the reasons for this in accordance with Law 9/2017 of 8 November and a report from the relevant legal service.
Proposal analyses the impact of the economic recovery on the existing contract in terms of risk sharing, commercial and financial viability, and fiscal impact.
Request form must be signed by the applicant for the report in accordance with Article 8 of Order HFP/1381/2021 of 9 December, which regulates the organisation and operation of the National Evaluation Office.
In the event that a report request is signed by an individual who is not referenced in Article 8 of Order HFP/1381/2021 of 9 December, which governs the structure and operations of the National Evaluation Office, the relevant proof of representation must be provided.
