Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter, RGPD) and the Organic Law 3/2018, of 5 December, on Personal Data Protection and Digital Rights Guarantee, defines the obligation to appoint a Data Protection Officer for any authority or entity of the public sector that processes personal data.
The duties of the Data Protection Officer (DPO) in this Ministry, excluding the Public Entities reporting thereto, have been taken over by the Technical General Secretariat and are exercised by the Subdirectorate General for Transparency Information, Data Protection and Web Services.

- Rights of the interested party: the interested parties may exercise the rights of access, to rectification, to erasure, restriction of processing, of opposition and portability of data, as per sections 15 to 22 of the RGPD.
