Act 9/2017, of 8 November, on Public Sector Contracts, transposing Directives 2014/23/EU and 2014/24/EU, of the European Parliament, of 26 February 2014, into Spanish law, establishes a new governance system to ensure compliance with public procurement regulations.
The Independent Office for Regulation and Supervision Public Procurement (OIReScon), a collegiate body created with the aim of ensuring the correct application of legislation and, in particular, to attendance and combat illegalities, in relation to public procurement, plays a key role in this system. The Office shall act for the development of its activities and fulfilment of its objectives, with full independence both at organic and functional level.
By means of the enactment of Royal Decree 342/2023 of 9 May, which approves the organisation and operation regulations of the Independent Office for Regulating and Monitoring Procurement, this organization is provided with a stable regulatory framework, exceeding the temporary regime valid until then by complying with the provisions set forth by section 4 of article 332 of the Act on Public Procurement (LCSP as per its Spanish acronym) and the mandate included in the fifth transitory disposition of Royal Decree 682/2021 that develops the basic organic stricture of the Ministry of Finance and Civil Service.
